The figure of Arraigo Laboral is a type of temporary residence for exceptional circumstances that can be obtained by foreigners who have been residing in Spain irregularly for at least two years and who can prove the existence of an employment relationship of at least six months.

However, we find that prior to the recent Supreme Court Ruling 1184/2021, in order to prove the employment relationship for a minimum period of six months, it was necessary to:

To have a court decision.
Or, to have an administrative resolution confirming an act of the Labor and Social Security Inspection.
Therefore, the means available to accredit the existence of the labor relationship were very limited and caused the need for the worker to denounce his employer in order to be able to accredit the contractual link and in many occasions, we find that the worker does not agree to act in this way.

However, with the arrival of the Supreme Court Ruling, the assumptions to be able to request the Arraigo Laboral are extended, since different options are established to accredit the existence of the labor relationship, being able to provide, for example, the Report of Labor Life that accredits the labor relationship during a minimum of 6 months.

The aforementioned assumption applies to all cases of foreigners in Spain who have had a residence, stay or international protection and who have subsequently lost it, it has expired or it has been denied.

We leave you with some of the assumptions:

Holders of red card (asylum application) that while they were in the process of the asylum application and they were given the card and, therefore, they were authorized to work. If finally, they were denied asylum and manage to demonstrate two years in Spain and the link of the labor relation of a minimum of six months through the Report of the Labor Life.
Holders of a certain residence and work permit or a permit granted under Law 14/2013 and who for certain reasons could not renew their permit and manage to demonstrate two years of stay in the country and the labor link of at least six months through the Life Report.

Holders of a residence and work permit who were denied a permit or whose permit was canceled because they had a criminal record and have already canceled the criminal and police record and can demonstrate two years in Spain and through the Labor Life Report the labor relationship of at least six months.
Holders of a temporary residence permit under the communist regime who had their permit retroactively terminated when they applied for a permanent residence permit because, by virtue of article 9.4 a) of RD 240/2007, they did not modify their permit within three months of the dissolution of the link that gave them the right to the permit.

¿Te encuentras en España de manera irregular y has estado trabajando en España?

Entonces muy probablemente el arraigo laboral sea tu mejor opción para regularizar tu situación en el país.

La figura de Arraigo Laboral es un tipo de residencia temporal por circunstancias excepcionales que pueden obtener los extranjeros que han residido en España de manera irregular durante un mínimo de dos años y que puedan demostrar la existencia de una relación laboral de un mínimo de seis meses.

No obstante, nos encontramos con que anteriormente a la reciente Sentencia del Tribunal Supremo 1184/2021, para acreditar el vínculo de la relación laboral por un período mínimo de seis meses, era necesario:

Disponer de una sentencia judicial
O bien, disponer de una Resolución administrativa que confirme un Acta de la Inspección de Trabajo y Seguridad Social
Por tanto, los medios que se disponían para poder acreditar la existencia de las relaciones laborales eran muy limitados y provocaba la necesidad de que el trabajador debía de denunciar a su empleador para poder conseguir acreditar el vínculo contractual y en muchas ocasiones, nos encontramos con que el trabajador no está de acuerdo en actuar de este modo.

Sin embargo, con la llegada de la Sentencia del Tribunal Supremo, se amplían muchísimos los supuestos para poder solicitar el Arraigo Laboral, ya que se establecen diferentes opciones para acreditar la existencia de la relación laboral, pudiendo aportar por ejemplo, el Informe de Vida Laboral que acredite la relación laboral durante un mínimo de 6 meses.

El mencionado supuesto aplica a todos los casos de extranjeros en España que han tenido una residencia, estancia o protección internacional y que la han perdido posteriormente, que les ha caducado o que les ha sido denegada.

Os dejamos con algunos de los supuestos:

Titulares de tarjeta roja (solicitud de asilo) que mientras estaban en proceso de la solicitud de asilo y les daban la tarjeta y, por tanto, estaban autorizados a trabajar. Si finalmente, le denegaron el asilo y logran demostrar dos años en España y el vínculo de la relación laboral de mínimo seis meses a través del Informe de la Vida Laboral.
Titulares de un determinado permiso de residencia y trabajo o de un permiso concedido al amparo de la Ley 14/2013 y que por determinadas razones no pudieron renovar su permiso y logran demostrar dos años de estancia en el país y el vínculo laboral de al menos seis meses a través del Informe de Vida
Titulares de un permiso extinguido de Larga Duración y que no pudieron hacer uso de la Recuperación de la Larga Duración y logran demostrar dos años en España y a través del Informe de Vida Laboral el vínculo laboral de al menos seis meses
Aquellos que se quedaron en situación irregular por haber permanecido más tiempo del tiempo legalmente establecido fuera de España y logran demostrar dos años en España y a través del Informe de Vida Laboral el vínculo laboral de al menos seis meses

Titulares de un determinado permiso de residencia y trabajo a quienes les denegaron el permiso o se lo extinguieron porque tenían antecedentes penales y ya tienen cancelados los penales y policiales y consiguen demostrar dos años en España y a través del Informe de la Vida laboral el vínculo de al menos seis meses
Titulares de un permiso de residencia temporal en régimen comunitario a quienes les extinguieron con carácter retroactivo el permiso cuando solicitaron la permanente porque en virtud del artículo 9.4 a) del RD 240/2007 no modificaron en el plazo de los tres meses desde que se disolvió el vínculo que les dio derecho a ese permiso
